Terms of Use

These terms govern access to CallCanary, a live call routing service for SaaS incident response teams. They are written for practical operation: configure your Lines responsibly, tell callers what they need to know, and use the service for lawful business purposes.

If you or your organization signs an order form or separate written agreement with CallCanary, that agreement controls where it conflicts with these Terms.

1. Agreement

These Terms of Use are an agreement between you and CallCanary. By accessing the website, creating an account, configuring a Line, or using the service, you agree to these Terms and to our Privacy Policy.

If you use CallCanary on behalf of an organization, you represent that you are authorized to bind that organization. In that case, "you" and "customer" refer to that organization.

2. The service

CallCanary provides live call routing for business incident response. The service may include phone Lines, AI Agents, call intake, routing, recordings, transcripts, summaries, notifications, usage records, administrative tools, and related support.

CallCanary is not an emergency service, 911 service, medical service, security monitoring provider, or guaranteed human dispatch center. You are responsible for deciding whether CallCanary is appropriate for your incident response workflow and for maintaining backup processes for critical situations.

3. Accounts and organizations

You are responsible for keeping account information accurate, protecting login credentials, managing organization access, and promptly removing users who should no longer have access.

Organization administrators may configure Lines, Agents, instructions, billing, integrations, and user access. Actions taken through an account or organization may be treated as authorized by that customer.

4. Customer content and caller data

You retain ownership of the content you submit to CallCanary and the call records generated for your organization. You grant CallCanary the limited rights needed to host, process, transmit, transcribe, summarize, route, display, store, secure, and support that content as part of the service.

You are responsible for your call flows, caller disclosures, recording notices, consent requirements, and the lawful collection and use of information from callers. Do not use CallCanary to collect sensitive regulated information unless your agreement with CallCanary expressly allows it and your organization has configured the service for that use.

5. AI and routing limitations

CallCanary uses automation and AI-assisted processing to answer calls, collect details, summarize conversations, and route incident context. AI outputs can be incomplete, delayed, or incorrect. You are responsible for reviewing outputs, configuring instructions, and deciding how much to rely on automated routing.

We work to make the service reliable, but we do not guarantee that every call will be answered, transcribed, summarized, delivered, or routed without interruption. Telephony networks, cloud providers, AI providers, and connected third-party tools may also affect service behavior.

6. Acceptable use

You may not use CallCanary to:

  • violate law, privacy rights, intellectual property rights, or contract rights;
  • send spam, abusive communications, malware, or fraudulent content;
  • harass, threaten, exploit, or harm another person;
  • interfere with the service, probe security, scrape data, or bypass rate limits;
  • reverse engineer the service except where law allows it despite this restriction;
  • use the service or outputs to build a competing service or model; or
  • submit information you are not authorized to process through CallCanary.

We may suspend or limit access if we believe use of the service creates legal, security, operational, or trust and safety risk.

7. Fees, plans, and payment

Paid plans, Lines, included minutes, minute blocks, taxes, and any usage-based charges are described on the website, in the application, or in an order form. You authorize CallCanary and its payment processors to charge the payment method on file for fees due.

Fees are non-refundable except where required by law or expressly stated in a written agreement. We may suspend paid features for unpaid amounts, failed payment methods, suspected abuse, or material breach of these Terms.

8. Legal terms

Third-party services

CallCanary depends on third-party services for telephony, hosting, speech processing, AI processing, payments, email, analytics, and integrations. Those services may be governed by their own terms.

Intellectual property

CallCanary and its software, design, documentation, trademarks, and related materials are owned by CallCanary or its licensors. You may not copy or use them except as allowed by these Terms.

Disclaimer

The service is provided "as is" and "as available" to the fullest extent permitted by law. CallCanary disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, CallCanary will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of goodwill, business interruption, or loss or corruption of data. CallCanary's aggregate liability for claims relating to the service will not exceed the amounts paid by the customer to CallCanary for the service giving rise to the claim during the twelve months before the event giving rise to liability.

Indemnity

You will defend and indemnify CallCanary from claims arising from your content, your caller disclosures or consent practices, your use of the service in violation of law, or your breach of these Terms.

Governing law

Unless a written agreement says otherwise, these Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict of laws rules.

9. Changes, termination, and contact

We may update these Terms as the service, laws, or our business change. If changes are material, we will provide notice when required. Continued use of the service after changes take effect means you accept the updated Terms.

You may stop using the service at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees, create risk for the service or others, or if we discontinue the service.
